1. Acceptance of Terms

By downloading, installing, or using TrustForge (the "Software") or accessing the TrustForge website (the "Website"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software or Website.

2. Not Legal Advice

TrustForge is a software tool that assists with drafting trust and estate planning documents. It is not a law firm, legal service, attorney, or substitute for professional legal counsel. TrustForge does not provide legal advice, legal representation, or interpretation of law.

Documents produced by TrustForge are templates and drafting aids. They may not comply with the laws of every jurisdiction. You are solely responsible for ensuring that any documents you create meet applicable legal requirements. We strongly recommend having all documents reviewed by a licensed attorney in your jurisdiction before execution.

3. License Grant

Upon payment of the one-time fee, you are granted a perpetual, non-exclusive, non-transferable license to use the specific version of TrustForge that you purchased (the "Purchased Version") on devices you own or control. This license includes all minor updates, patches, and bug fixes for the Purchased Version.

This license does not entitle you to future major versions or releases (e.g., a v1.0 purchase does not include v2.0 or later). Future versions may be offered as separate purchases at the discretion of TrustForge.

You may not redistribute, sublicense, reverse engineer, decompile, or share the Software or its license with third parties.

4. Free Trial

The free trial provides limited access to the latest demo version of the Software for evaluation purposes. The trial is limited to one trust, excludes document export and import functionality, and expires 14 days from first launch. Trial limitations are enforced by the Software and may not be circumvented.

The trial license applies only to the specific demo version downloaded and does not entitle you to future versions or upgrades.

5. User Responsibility & Misuse

You are solely responsible for:

• Your use of the Software and Website
• The accuracy and completeness of any documents you create
• Compliance with all applicable laws and regulations in your jurisdiction
• Maintaining the security of your passphrase and device
• Any consequences arising from your use or misuse of the Software

TrustForge is not liable for any misuse of the Software or Website. This includes, but is not limited to, improper execution of documents, failure to comply with jurisdictional requirements, unauthorized access to your device, or loss of data due to hardware failure, user error, or any other cause.

6. Data & Privacy

All estate planning data created within the Software is stored locally on your device and encrypted using AES-256-GCM. TrustForge does not transmit, collect, or have access to your estate planning data. For details on the minimal data collected by the Website, see our Privacy Policy.

TrustForge is not liable for loss, corruption, or unauthorized access to your data. You are responsible for maintaining backups of your data and securing your device and passphrase.

7. Disclaimer of Warranties

The Software and Website are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

TrustForge does not warrant that the Software will be error-free, uninterrupted, or that documents generated will be legally valid or enforceable in your jurisdiction.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TrustForge, its developers, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use or inability to use the Software or Website
• Any documents created using the Software
• Unauthorized access to or alteration of your data
• Any reliance on documents or information produced by the Software
• Legal consequences arising from the use of generated documents

This limitation applies regardless of whether TrustForge has been advised of the possibility of such damages.

9. Refunds

Due to the nature of digital software products, all sales are final. No refunds will be issued after download access has been granted.

10. Changes to Terms

TrustForge reserves the right to modify these Terms of Service at any time. Updated terms will be posted on this page with a revised "Last updated" date. Continued use of the Software or Website after changes constitutes acceptance of the updated terms.
